Sponsor The sponsor of Bose x NFL Fan Cave Upgrade Sweepstakes (the “Sweepstakes”) is Bose Corporation, a Delaware corporation with a principal address at 100 The Mountain Road, Framingham, MA, United States, 01701 (“Sponsor”).

Contest description The Sweepstakes begins on September 8, 2021 at 9:00 AM Eastern Standard Time (“EST”) and ends on September 23, 2021 at 11:59:59 PM EST (the “Sweepstakes Period”). The Sweepstakes consists of certain communications from Bose requesting entries into the Sweepstakes (the “Call for Entries”). The Call for Entries may be given through an email invitation from Sponsor, social media post on a social media channel(s) of Sponsor, or through other media of Sponsor.

Eligibility This Sweepstakes is only open to those who properly enter in the Sweepstakes (“Entrants”) as described herein, and who are 18 or older as of the date of entry. The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia. Employees, directors, and officers of Sponsor, The National Football League (the “NFL”), its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties, LLC, NFL Enterprises LLC, NFL Productions LLC, NFL International LLC, their respective affiliates, subsidiaries, advertising, promotion agencies including Creative Artists Agency, and the National Football League, all of its member professional football teams, including any of its employees and any employee of a National Football League team (collectively “Sweepstakes Entities”), and their immediate family members and all others residing in the same household of such people are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations, and is void where prohibited. By submitting an entry, Entrants consent to the use of their registration information in accordance with the Bose Privacy policy. Entrants agree to the release of their names, addresses, and email information to Sponsor for winner notification purposes, and for public winner disclosures as required by law.

Agreement to rules By participating in the Sweepstakes, Entrants agree to be fully and unconditionally bound by the Rules, and Entrants represent and warrant that they meet the eligibility requirements set forth herein. In addition, Entrants agree to accept the decisions of Sponsor, which shall be final and binding in all respects relating to the Sweepstakes. Failure to strictly follow the Rules may result in disqualification from the Sweepstakes and/or forfeiture of any prize(s) received.

Sweepstakes task Entrants are required to complete the following task during the Sweepstakes Period in order to be entered into the Sweepstakes to win a Prize: 

How to enter Eligible Entrants must meet Eligibility and must complete the Sweepstakes task to be eligible to win a Prize. Entries that are incomplete, illegible, corrupted, damaged, destroyed, false, forged, lost, late, misdirected, deceptive, or otherwise do not adhere to the Rules may be disqualified at the sole discretion of the Sweepstakes Entities. Entrants may enter only once and must complete and provide all information requested. Entrants may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the Rules. Any entries submitted by Entrants determined to be using fraudulent entry methods or other attempts to circumvent the Rules will be disqualified and any Prizes awarded shall be forfeited.

Entrants may also enter the Sweepstakes by printing their full name, street address, city, state, ZIP code, telephone number, and email address on a standard 4″ x 6″ postcard and mail it to: Bose Corporation NFL Fan Cave Sweepstakes, Attn: Kyle Graham, 100 The Mountain Road, Framingham, MA 01701. Mail-in entries must be postmarked within the Sweepstakes Period and received within 7 days of the end of the Sweepstakes Period. Only potential winners will be notified by email, telephone, regular mail, or overnight mail. LIMIT ONE (1) MAIL-IN ENTRY PER PERSON / E-MAIL ADDRESS / POSTCARD.

Prizes

The specifics of the Prizes shall be solely determined by the Sponsor. No cash or other Prize substitution is permitted except at the Sponsor’s sole discretion. All Prizes are nontransferable and cannot be resold or exchanged for cash if a non-cash Prize. Limit of one (1) Prize per person and/or household. The winner of the Prize is not entitled to any difference between the actual value of the Prize and the approximate retail value stated herein. Any and all Prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of each winner.

The total approximate retail value of the Prizes in the Sweepstakes is $4,154.00.

Odds The odds of winning depend on the number of eligible entries received.

Winner selection and notification Winners of the Sweepstakes will be selected at random by Sponsor. Winning Entrants will be notified via email within two (2) weeks following the selection and must return an acknowledgment message within ten (10) days of notification. Winners will receive their Prize by mail or as otherwise instructed by the Sponsor. Sponsor shall have no liability for a winner’s failure to receive notices due to winner’s spam, junk email or other security settings, or for winner’s provision of incorrect or otherwise non-functioning contact information.

At the sole discretion of Sponsor, disqualification and forfeiture may result from any of the following: (1) a potential winner’s failure to respond to validly claim the prize in the time frame designated by Sponsor for acknowledgment; (2) the return of a winning notification as undeliverable; (3) a potential winner’s failure to provide Sponsor with satisfactory proof of age, identity, and residency; and (4) any other non-compliance with the Official Rules. In the event of forfeiture, the Prizes may be awarded to an alternate Entrant. Upon prize forfeiture, no compensation will be given and Sponsor will have no further obligation with respect to that Prize or portion of the Prize.

Rights granted by winners By accepting the Prize, the winner agrees to allow Sponsor, the NFL Entities (as defined below) and their respective subsidiaries and affiliates, promotional, and advertising agencies, and representatives the right to use his/her name, biographical information, image, photos, and/or likeness, and statements for programming, promotion, trade, commercial, advertising, and publicity purposes in connection with this Sweepstakes, at any time or times, in all media now known or hereafter devised, worldwide, without notice, review or approval and without additional compensation, except where prohibited by law.

Sponsor respects your right to privacy. Personal contact information collected from Entrants will only be used by Sponsor to administer the Sweepstakes and, only if consent is actively given at the time of entry, to provide Entrants with information regarding upcoming promotions and/or events from Sponsor.

Suspension / Modification / Termination Sponsor reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes should (in its sole discretion) a virus, bug, non-authorized human intervention, fraud, or other causes beyond Sponsor’s control corrupts or affects the administration, security, fairness, or proper conduct of the Sweepstakes. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or Instagram or Sponsor website or violates these Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to, multiple entries from the same user from different IP addresses, multiple entries from the same computer in excess of that allowed by Sweepstakes rules, or the use of bots, macros or scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

Third-party apps or websites Where a Sweepstakes involves access to or use of a third-party app or website (“Third-party Site”), Entrants understand and agree that: (a) Sweepstakes Entities have no control over the Third-party Site whatsoever; (b) Entrant is solely and fully responsible for their dealings with the Third-Party Site and is alone responsible for making whatever investigation they feel is necessary or useful before commencement of dealings, and taking all precautions deemed necessary to protect themselves from viruses, worms, Trojan horses, malware, and other harmful or destructive materials potentially residing on the Third-Party Site; and (c) Sweepstakes Entities disclaim all responsibility for any harm resulting from Entrant’s access to or use of a Third-Party Site. Sweepstakes Entities further assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to or alteration of entries, or any problem or technical malfunctions of any telephone network or line, computer online systems, servers, or providers, computer equipment, software, failure of any online Sweepstakes entry to be received on account of technical problems or traffic congestion on the Internet or at any website (including a Third-party Site), or any combination thereof, which may limit a Entrant’s ability to participate in the Sweepstakes.

INVALID ENTRY Sponsor reserves the right at their sole discretion to disqualify any individual who is found (i) to be tampering with the entry process or the operation of the Sweepstakes; (ii) to be acting in violation of the Official Rules; or (iii) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY ENTRY OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO DISQUALIFY SUCH ENTRANT OR INDIVIDUAL AND SEEK DAMAGES OR ANY OTHER REMEDY FROM ANY SUCH ENTRANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability Sweepstakes Entities and their  agents are not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions including lost, misappropriated or corrupted entries, virus, worm or Trojan Horse damage, or any other damage which may limit a Entrant’s ability to participate in the Sweepstakes. Finally, the Entrant represents and warrants to Sweepstakes Entities that the entry will not contain content that she or he does not have the right to transmit under any law, contract or fiduciary relationship, or which contains any viruses or any other information that may damage or otherwise interfere with any computer systems, data, or that of other users.

IN NO EVENT WILL THE SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, FOR INJURIES, DAMAGES OR LOSSES TO PERSONS AND PROPERTY, INCLUDING BODILY INJURY AND DEATH, WHICH MAY BE SUSTAINED IN CONNECTION WITH SUBMITTING AN ENTRY OR OTHERWISE PARTICIPATING IN ANY ASPECT OF THE SWEEPSTAKES, THE RECEIPT, OWNERSHIP OR USE OR MISUSE OF ANY PRIZE AWARDED, OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO AND FROM ANY PRIZE-RELATED ACTIVITY OR ANY TYPOGRAPHICAL OR OTHER ERROR IN THE PRINTING OF THESE OFFICIAL RULES OR THE OFFERING OR ANNOUNCEMENT OF ANY PRIZE, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF YOUR ACCESS TO AND PARTICIPATING IN THE SWEEPSTAKES AND/OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. Indemnification By participating in the Sweepstakes, each Entrant defends, indemnifies, and holds harmless the Sweepstakes Entities and each of their respective subsidiaries, affiliates shareholders, owners, members, officers, directors, agents, representatives, and employees in connection with this Sweepstakes and hold them harmless from and against any and all costs, claims, damages, (including, without limitation, any special, incidental or consequential damages), or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Sweepstakes, or arising out of participation in any Sweepstakes related or prize related activity, or the receipt, enjoyment, participation in, use or misuse, of any Sweepstakes or prize related activity, whether hosted by Sponsor or a third party.

Miscellaneous The Sweepstakes shall be governed by the laws of the Commonwealth of Massachusetts and the federal laws of the United States applicable therein without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. As a condition of participating in this Sweepstakes, Entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than Entrants’ actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

All taxes, fees, and surcharges on prizes are the sole responsibility of the prize winners. Any winner agrees to provide Sponsor with necessary information to complete any necessary I.R.S. 1099 and other forms.

NFL DISCLAIMER: The National Football League, their member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC, NFL Productions, LLC, NFL International, LLC, NFL Players Association, NFL Players Incorporated, and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, members, representatives, and employees (collectively, the “NFL Entities”) will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or any prize awarded.
